In considering the prosecuting attorney's petition, we must first determine whether this court may properly grant the relief sought. Only upon determining that a writ of prohibition may issue can we then proceed to resolve the substantive issues presented.*fn3 Under the view we take of this case and for the reasons which follow, however, we need not reach those issues; for, on these facts, we hold that a petition for a writ of prohibition does not lie.
